ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

I hereby assume all of the risks participating in Be Elite, Flag Football League including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of possible liability without fault. I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in Be Elite, Flag Football League. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the Be Elite, Flag Football League in which I may participate and that it will govern my actions and responsibilities at said Be Elite, Flag Football League. In consideration of my application and permitting me to participate in Be Elite, Flag Football League, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from Be Elite, Flag Football League.

THE FOLLOWING ENTITIES OR PERSONS:

ALL associated with Be Elite Athlete, and/or their coaches, agents, representatives, or volunteers.
(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in Be Elite, Flag Football League, whether caused by negligence or otherwise. I acknowledge that Be Elite, Flag Football League may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration. I consent and agree that Be Elite, Flag Football League, and/or their coaches, agents, representatives, or volunteers may take photographs or digital recordings of me as a participant during this event and use these in any and all media for training or promotional purposes. I further consent that my identity may be revealed therein or by description text or commentary. I waive any rights, claims, or interest and I understand that there will be no financial or other remuneration. The accident waiver, release of liability, and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL.

Code of Conduct Waiver:

Code of Conduct Youth sports programs play an important role in promoting the physical, social and emotional development of children. It is therefore essential for players, parents, coaches and officials to encourage youth athletes to embrace the values of good sportsmanship. Moreover, all involved in youth sports events should be models of good sportsmanship and should lead by example by demonstrating fairness, respect and self-control. Therefore, all players, parents, coaches and spectators will abide by the following rules:

1. I will not engage, or encourage my child to engage in unsportsmanlike conduct with any coach, parent, player, participant, official or any other attendee, such as booing and taunting, refusing to shake hands, or using profane language or gestures.
2. I will not engage in any behavior which would endanger the health, safety or well-being of any coach, parent, player, participant, official or any other attendee.
3. I will not engage in verbal or physical threats or abuse aimed at any coach, parent, player, participant, official or any other attendee.
4. I will not use, or encourage any other person to use drugs or alcohol while at games, and will not attend, coach, officiate or participate in any league event while under the influence of drugs or alcohol.
5. I will be a positive role model and encourage sportsmanship by showing respect and courtesy, and by demonstrating positive support for all players, coaches, officials and spectators at every game, practice or event.
6. I will treat nay coach, parent, player, participant, official or any other attendee with respect regardless of race, creed, color, national origin, sex, sexual orientation or ability.
7. I will refrain from coaching my child or other players during games and practices, unless I am one of the official coaches of the team.
8. I will respect the officials and their authority during games, and will never question, discuss, or confront coaches at the game field, and will take time to speak with coaches at an agreed upon time and place.
9. I will teach my child that doing one’s best is more important than winning, so that my child will never feel defeated by the outcome of a game or his/her performance.
10. I will remember that youth sports are played for fun and the game is played for the youth and not for the adults.

Individuals who fail to conform to the foregoing while attending, coaching, officiating or participating in any game will be subject to disciplinary action, including but not limited to the following in any order or combination as decided by the league:

1. Verbal warning issued by the league.
2. Written warning issued by the league.
3. Immediate ejection from the game.
4. Suspended from a game, or multiple games.
5. Removal from the league

I hereby consent to the publication and use of my child’s name and/or my child’s likeness (the ‘Likeness’) for the purpose of promotion, publicity, advertising, or other manner or media by Be Elite, or any other representative authorized to act on behalf of Be Elite. Likeness includes, but is not limited to, photographs, sound and/or video recordings, films, broadcasts, brochures, publications, reports, web pages, promotional materials or any other audio-visual, electronic, printed, tangible work in any media or format, now known or hereafter to become known, and/or reproductions of any of these. I agree that the actual material involved are, and shall continue to be, the property of Be Elite and that neither I, nor my child, shall have any right of review or approval regarding the use of my child’s name and/or Likeness in such material. I hereby release and hold harmless Be Elite, along with its respective employees, agents, affiliates, sponsors, or other representatives from any and all claims, demands, or causes of action arising out of the use of my child’s name and/or Likeness, in accordance with the terms of this release. I understand and agree that neither I, nor my child, will be compensated in any way for the use of my child’s name and/or Likeness by Be Elite. I understand that for any reason and at any point in time, I may decide to revoke this agreement by notifying Be Elite Athlete in writing, in which case all references to my child’s Likeness will be removed within a reasonable time period and no longer used.

REFUND POLICY

Please read the following policy in its entirety. In order to better serve our families and participants, Be Elite Athlete has implemented the following guidelines on refunds with regards to registration fees.

There will be no refunds, once a player has been registered and the registration fee has been processed. After a player has fully registered they are placed on a roster, and a custom jersey and shorts have been ordered.

WAIVER & RELEASE FOR COMMUNICABLE DISEASE INCLUDING COVID-19:

In consideration of being allowed to participate on behalf Be Elite Flag Football program and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1. Participation includes possible exposure to and illness from infectious diseases, including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation regarding protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless Be Elite Athlete, SARASOTA COUNTY SCHOOL BOARD & their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), with respect to any and all illness, disability, death, or loss or damage to person or property, weather arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE to the fullest extent provided by law.
