ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM
I hereby assume all of the risks participating in Be Elite Elite, Flag Football League including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of possible liability without fault. I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in Be Elite Elite, Flag Football League. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the Be Elite Elite, Flag Football League in which I may participate and that it will govern my actions and responsibilities at said Be Elite Elite, Flag Football League.
In consideration of my application and permitting me to participate in Be Elite Elite, Flag Football League, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from Be Elite Elite, Flag Football League.

THE FOLLOWING ENTITIES OR PERSONS:
ALL associated with Be Elite Athlete, and/or their coaches, agents, representatives, or volunteers.
(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in Be Elite Elite, Flag Football League, whether caused by negligence or otherwise. I acknowledge that Be Elite Elite, Flag Football League may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration. I consent and agree that Be Elite Elite, Flag Football League, and/or their coaches, agents, representatives, or volunteers may take photographs or digital recordings of me as a participant during this event and use these in any and all media for training or promotional purposes. I further consent that my identity may be revealed therein or by description text or commentary. I waive any rights, claims, or interest and I understand that there will be no financial or other remuneration. The accident waiver, release of liability, and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL.

REFUND POLICY
Please read the following policy in its entirety.
In order to better serve our families and participants, Be Elite Athlete has implemented the following guidelines on refunds with regards to registration fees for our After School Program.

1. Refunds will be assessed based on the following:
   • Player or parent changes their mind 7 days before the first day of the event.
2. Refunds will NOT be assessed based on the following:
   • Holidays
   • Weather Cancellations
   • Player becomes quarantined
   • Event changes or cancellations related to Covid-19
   • Player withdraws from participation after the start of the program for ANY reason*

WAIVER & RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19:
In consideration of being allowed to participate on behalf Be Elite Flag Football program and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1. Participation includes possible exposure to and illness from infectious diseases, including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation regarding protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless Be Elite Athlete, SARASOTA COUNTY SCHOOL BOARD & their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), with respect to any and all illness, disability, death, or loss or damage to person or property, weather arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.
